The lok adalat, headed by Jagroop Singh Mahal, maintained that if possession is not delivered within time the coloniser would pay 9% per annum interest on the deposited amount and shall also pay Rs 50,000 as compensation and Rs 10,000 as litigation cost.

Dr Rajan Katoch, a resident of Palampur in HP, had filed a complaint alleging that he had agreed to purchase a flat from the coloniser for Rs 17 lakh.

He had paid Rs 16.5 lakh after which the coloniser cancelled his allotment and forfeited 20% of the amount deposited by him. The coloniser contended that the applicant was a chronic defaulter and therefore the allotment was cancelled as per the agreement.

The adalat allowed the application holding that the delay in payment of installments had been condoned by the coloniser because they continued receiving the part payments from the applicant without any objection and did not serve any notice on him before cancellation. The respondent was directed to complete the construction and obtain completion certificate within two months and give the applicant possession of the flat.
