HC rejects Shahabuddin bail plea

The Patna HC rejects the bail plea of RJD MP who is sentenced to life by a trial court in connection with the kidnapping and murder of a CPI-ML worker.

The Patna High Court on Wednesday rejected the bail application of RJD MP Mohammed Shahabuddin, sentenced to life by a trial court in connection with the kidnapping and murder of a CPI-ML worker.

Rejecting the jailed Lok Sabha member's plea, a division bench comprising justices Shivkirti Singh and SM Mahfooz Alam said "at this stage bail cannot be granted".

Shahabuddin had moved the high court on May 24 against his conviction and sentencing in the kidnapping and murder of a CPI-ML worker eight years ago and his appeal was admitted for hearing.

In the meanwhile, he had filed a petition for bail.

While handing down life term to Shahabuddin on May eight, additional district and sessions judge of Siwan Gyaneshwar Prasad Srivastava had also imposed a fine of Rs 10,000 on him.

The judge had found him guilty under section 364 (kidnapping or abducting in order to murder), in the case relating to kidnapping of CPI-ML worker Chotelal Gupta on February 7, 1999

The prosecution had failed to establish the murder of Gupta as his body was never found.
