The police had registered a case on September 11, 2013, on the complaint of the victim's mother. She had alleged that Rakesh had kidnapped her daughter and later raped her. The victim and her mother used to work as domestic helps.

In her complaint, the victim's mother claimed that her daughter had gone missing on September 9, after the victim left home for work but did not return. However, the victim returned after two days and her medical examination revealed that she was five-week pregnant.

Based on the allegations, the police had arrested Rakesh on September 23.

However, the case fell flat after the DNA of the foetus and the accused did not match and there were number of discrepancies in the statement of the victim. Contrary to the claims of the mother that the victim was 15-year-old, the ossification test showed her age between 17 and 19 years.
