Setback for Maharashtra minister Nawab Malik amid attempts to vote in RS polls

In a setback to Maharashtra minister Nawab Malik, the Bombay High Court bench of Justice Bharati Dangare refused to hear his amended petition which was filed seeking a police escort to take him to Vidhan Bhavan so that he may cast his vote in the Rajya Sabha elections.

During the hearing, Justice Dangare did say that as hearing the petition would mean setting aside the lower court order. As appealing against lower court order has to be done before a two judge bench, Justice Dangare did not comment further and rose.

He had moved the Bombay High Court after a special Mumbai court had rejected his and fellow NCP leader Anil Deshmukh's pleas seeking permission to vote in the elections.


Malik was arrested by the Enforcement Directorate on February 23 in connection with a money laundering case against fugitive gangster Dawood Ibrahim Kaskar.

The Enforcement Directorate had opposed the bail pleas of both the NCP leaders, stating that prisoners don't have voting rights under Representation of People's Act, 1950.
