CBI searches Raj Kumar’s room

A CBI team accompanied by forensic experts carried out searches in the room where Raj Kumar, the Nepalese servant of Dr Praful and Anita Durani, lives in Sector 53, Noida. The Duranis are family friends of Talwars.

“We had recovered some articles from this room on June 13. The same is being forensically examined. Various other clues are being followed,” said CBI Joint Director, Arun Kumar.

Raj Kumar’s bicycle was examined and the team took some material in two bags. The bathroom used by Kumar was sealed. Everything was video recorded and a psychologist was also accompanying the team. Anita Durani was also questioned.

The various contradictions emerging out of the tests carried out on Krishna are being examined by the CFSL.

Krishna was a regular at Raj Kumar’s quarter and it is suspected the latter has vital information relating to the murders. The two along with another help, Vijay Mandal, have been jointly questioned. Mandal’s room was also searched. The team left carrying some material in bags.

Another team continued searches in the block in Jalvayu Vihar where the Talwars live and lifted some material from the garage and Krishna’s room.

Krishna being framed: Defence

In court, Krishna’s defence counsel F.C. Sharma countered the CBI’s claims and said his client was innocent on the grounds that no recovery had been made during his three-day custody. Krishna was being implicated in the case and that he has not made any statements during the custody period, his counsel said.

The defence referred to Article 20 (3) of the Indian Constitution, which states no person accused of an offence shall be compelled to be a witness against himself. The defence also moved an application for providing them with the case diary relating to the case for their analysis, which was rejected by the court stating it cannot be provided for review in consonance with the provision of section 172(3) of the CrPC.

The defence cited a case of Kalpnathrai vs the state under section 172 CrPC and had requested the court to give them access to the case diary.

CBI counsel R.K. Saini cited remand is the matter between the prosecution and the court referring to the case of Amarpal vs the State of UP and opposition of remand by the defence is not justified.

During remand, Krishna would be allowed to keep a lawyer and should not be subjected to physical and mental torture, the court ordered.

The CBI also carried out a mock drill with Krishna at the Talwar’s residence.
