Forty nine days after he was arrested on charges of killing his daughter and domestic help, Dr Rajesh Talwar would walk out of Dasna Jail on Saturday, reports Peeyush Khandelwal.
Forty nine days after he was arrested on charges of killing his daughter and domestic help, Dr Rajesh Talwar would walk out of Dasna Jail on Saturday.
“We have informed the designated court in Ghaziabad that the agency has not found any evidence against Talwar. The court may pass an appropriate order,” the CBI said on Friday. Special Magistrate (CBI) Sapna Mishra granted him bail.
The court orders were passed late in the evening, which left the Talwar family with just over an hour to get the surety
papers and other documents prepared for his release.
The formalities and paper work at Dasna Jail could, however, not be completed in time and Talwar had to spend another night
in prison.
Asked why they had changed their stance suddenly, as only 10 days back they had told the court that Talwar was a suspect, CBI Joint Director Arun Kumar said, “We opposed his bail as the report of the second polygraph test was awaited.”
The investigating agency said that they had gone through case diaries of the Noida police and had found that there was no evidence against Talwar.
A CBI official said that it is surprising how Krishna managed to fool the Noida police that finally led them to arrest Talwar.
“CFSL and other forensic experts conducted a simulation exercise in front of two independent witnesses to check the sound level at the same time the murders had taken place by switching on both the air conditioners in the bedroom of the Talwars and that of Aarushi. Physics experts from CFSL said that no sound of either steps or opening of the door was heard in the Talwars’ bedroom,” Kumar said.
“As far as the CBI is concerned, it did not arrest Talwar. The court considered key issues and gave him custody,” CBI Director Vijay Shankar told a news channel.
The court ordered to release Talwar on sureties of Rs 5 lakh each and a personal bond of Rs 10 lakh.
Meanwhile, the Talwars are planning to file a defamation case against the Noida Police. The defence lawyer said, “We would talk to the family. Right now we are only concentrating on his release.
