The Supreme Court (SC) on Friday issued notices to the Central Bureau of Investigation (CBI) on a petition filed by the parents of Aarushi Talwar seeking transfer of their daughter's murder trial from Ghaziabad court to a Delhi court.
Rajesh Talwar and his wife Nupur also got relief as the SC said that the trial court in Ghaziabad would consider their application seeking to adjourn hearing in the case.
The couple is to appear before the court following the SC order rejecting their appeal challenging the order of the Allahabad high court that upheld summoning order against Talwars issued by the magistrate.
Talwars' counsel Sandeep Kapoor said, "The couple is now residing in Delhi. At least 67 witnesses are living in the Capital. Also, Rajesh was attacked during one of the hearings. Therefore, in the interest of justice, it would be appropriate to hold a trial here."
Aarushi was found murdered on May 15, 2008, and the body of Talwars' domestic servant Hemraj was recovered from the terrace of their Noida flat next day.
The Noida police had initially accused the parents of murdering Aarushi and had arrested Rajesh. However, the CBI that took over the probe later.
Two-and-half years after the incident, CBI filed a closure report in the case. It, however, said there was no prosecutable evidence against Talwars.
