Allahabad HC dismisses Vikas Yadav's plea
A plea filed by Vikas Yadav, awarded life sentence in the Nitish Katara murder case, to challenge his conviction by a Delhi court, has been dismissed by the Allahabad HC, which said it was not maintainable in Allahabad.
A plea filed by Vikas Yadav, awarded life sentence in the Nitish Katara murder case, to challenge his conviction by a Delhi court, was on Friday dismissed by the Allahabad High court, which said it was not maintainable in Allahabad.
A Division Bench comprising Justice Sushil Harkauli and Justice VK Verma, while dismissing the petition, said since Vikas was convicted and awarded a life sentence by the sessions court at Patiala House in New Delhi, an appeal challenging the same was not maintainable here.
Vikas, son of controversial western Uttar Pradesh politician DP Yadav, and his cousin Vishal were convicted and sentenced for the murder of MNC executive Nitish Katara whose alleged intimacy with his sister Bharati had not gone down well with him.
The criminal appeal, filed by Vikas in the Allahabad High Court on Tuesday, was opposed by the complainant's counsel who held that since the order was passed by a court in Delhi, it could be challenged only in the Delhi High Court.
Yadav's counsel, however, had argued that the appeal was maintainable as the murder and the investigation process had taken place in Ghaziabad which falls within the jurisdiction of the High Court in Allahabad.
In April this year, six years after the murder took place, Yadav was awarded the sentence by the Delhi court where the case was transferred from Ghaziabad following a Supreme Court order.
