Legal rulings deferred in Nithari case

A special CBI court in Ghaziabad on Tuesday deferred to March 24 filing of legal rulings in the alleged rape and murder of a teenaged girl Choti Payal, one of the victims of the gruesome Nithari killings.

CBI judge A K Singh deferred the hearing in the case to condole the untimely death of Additional Chief Judicial Magistrate Shikha Pathak (35) due to cancer, CBI advocate J P Sharma said.

Legal rulings were to be filed in the court on Tuesday by the prosecution and defence in the case in which Surinder Koli is the main accused.

Both the sides had concluded their arguments in the case on February 24 with the prosecution putting up Koli's confessional statement before the court saying that the accused allured the 14-year-old girl and raped her before murdering her inside Kothi no D-5 at Nithari in Noida.

Pleading on behalf of the accused, Defence advocate Subash Aggarwal had said Koli is innocent and the investigating agency made up a case against him as he was only a servant and not the master of the house.

He had also claimed that the confessional statement was made by Koli under the pressure of investigating agencies.

Out of a total 16 cases related to Nithari killings judgements have been pronounced in four. This is the fifth case being heard by the court in connection with the infamous killings.
