Mumbai woman says husband gave her triple talaq over a WhatsApp message

A 32-year-old housewife from Mira Road has alleged that her husband had pronounced triple talaq over WhatsApp in November, 2017. While addressing the media at Fort on Saturday, the 32-year-old said she had married a Virar-based man in 2012. “Though the meher amount was decided way before the wedding, after I got married, my husband and father-in-law would torture me, asking me to get more money and gold from my father, so that my husband could set up his business.

While addressing the media at Fort on Saturday, the 32-year-old said she had married a Virar-based man in 2012.

“Though the meher amount was decided way before the wedding, after I got married, my husband and father-in-law would torture me, asking me to get more money and gold from my father, so that my husband could set up his business. When I couldn’t take the torture, I left their house and returned to my parent’s place,” said the victim.

She added that she approached various police stations with her complaint, but none of them took cognisance of it.

“The man in question has already got engaged to someone else as of now. When I was approached in the matter in November last year, we filed a domestic violence case in Thane sessions court. However, while the case was still on, her husband pronounced talaq on her through WhatsApp,” said advocate Ranjan Rajgor.

Rajgor added that a non-cognisable offence in the triple talaq case has been filed at one of the police station at Mira Road.

When HT contacted the husband, he rejected the allegations and said he hadn’t pronounced talaq to her. He added that his lawyer would contact us with further details about the case, but we weren’t provided with the details.

This is the second case of instant triple talaq to be reported in the Mumbai Metropolitan Region (MMR), with there being a First Information Report (FIR) filed at a police station in Kurla under the domestic violence act in the first case.

The Supreme Court had last year struck down the practice of instant triple talaq. Muslim Women (Protection of Rights on Marriage) Bill, 2017, which was passed in Lok Sabha during the winter session, criminalises the practice and classifies triple talaq as a cognisable and non-bailable offence, with three years’ imprisonment and a fine. However, the bill hasn’t been passed in Rajya Sabha.
