Drink-driving case: Gadkar files third bail plea, this time before the sessions court

Gadkar moved a fresh application on the ground that investigation is complete, and no harm would be caused if she is released on bail. The bail application is likely to be heard on Tuesday.

On June 9, the 35-year-old, accused of drunk driving, allegedly crashed her car into a taxi as she drove on the wrong side of the Eastern Freeway, killing two people and injuring four others. She moved her first bail application two days after being arrested, when she was remanded in judicial custody on June 12.

The magistrate court rejected her first bail application on June 26, holding that investigation in the case was still pending and she may influence the witnesses.

Twenty days after her first bail plea was turned down, she had again moved the magistrate court for bail on July 14, on the ground that investigation is almost complete and she has been in judicial custody for more than 40 days.

The magistrate court on Friday rejected her second bail application. Metropolitan magistrate Richa Khedekar, in her three page order, said, “Merely passing of more days cannot be considered as a ground for change in circumstances. The offence registered against the accused under 304 (II) of Indian Penal Code is serious in offence and it is exclusively triable by the sessions court. Hence, it is held that second bail application is not tenable and it is liable to be rejected.”

This is Gadkar’s third bail application in which she stated the police have already recorded the statements of the witnesses before the magistrate. Gadkar’s medical report and report of RTO officer about the vehicle has also been collected. She also said she had cooperated with investigation and so she should be released on bail.
