Based on an interview by former commissioner of police Hasan Gafoor, Juhu-based businessman Goldie Sud (43) filed a public interest litigation (PIL) seeking action against these officers and their suspension, pending inquiry, In his interview, Gafoor said that these IPS officers failed to follow orders of the then police commissioner.

Sud, a real estate dealer and an international trader, filed the PIL on Tuesday seeking that the commissioner of police D. Sivanandhan act on the allegations made by the former CP Gafoor and initiate inquiry against these officers.

“These officers have committed an act of culpable homicide not amounting to murder under section 304 and 304(a) of Indian Penal Code, and so they should be sent for trial, who all (these officers) are being protected by the politicians,” states Sud’s PIL.

Had the senior officers obeyed the orders, the terror situation could have been brought under control much earlier and many lives could have been saved, states Sud’s petition, adding that probably two more terrorists could have been caught alive.

The petition quotes Gafoor as saying that these officers disobeyed his orders, failed to perform their duties on the fateful night, refused to combat with the terrorists and preferred to stay away from the trouble-zones and made false reports to the control room and records.

Sud had written to the chief secretaries of the central and state governments and to police commissioner D. Sivanandhan asking for action against these officers, but did not receive any reply. He then filed the PIL.

“It is due to neglectful, coward and willful failure to control the situations of the Respondents nos. 4 to 7 (four officers) that this city is facing time and again law and order situations,” states the petition. The petition has been signed by at least 50 other people and is likely to come up for hearing later this week.
