Arrested African youths may face charges for overstaying in India too

The two African youths who were tied to a pole with a rope for nearly an hour after they allegedly tried to steal money from a shop at Joginder Nagar locality in the city on Tuesday and later arrested may also face charges of overstaying in the country since their visas have long expired.

Moreover, they had not applied for extension of their visas with the authorities concerned.

Investigations conducted by the Rama Mandi police revealed that the student visa of Rwandan youth Irakarama Aiaier was valid till August 25 this year.

Similarly, the visa of the his friend Sinarinli Alain, who hails from Burundi, was valid till January 18 last year, meaning he overstayed in the country for about 21 months.

These details were collected from the foreigner registration centre of Kapurthala police.

The police said around 1,300 students from such African countries are registered with the centre presently.

The police have now written to the district attorney (legal) for his comments before registering a case against the two under the Foreigner Act, 1946.

Shankuntla, a resident of Rama Mandi, had also lodged a complaint that two African students had also stolen `1,500 from her shop.

The police have been contacting students from African countries to get some clue about the third African youth, Ncuti Roger a Rwandan national, who was also booked in Tuesday’s incident.

The police have also found the president of the association formed primarily by students from African countries in Jalandhar and sought his help to nab the absconding youth.

Rama Mandi police station SHO Bimal Kant said, “As per law, the two students will face section 14 of the Foreigners Act. But we have written to district attorney (legal) before registering a case.”

The SHO said if the visa of any student expired he enjoys immunity for just one or two months in certain cases. But in that case too, he might be fined by the authorities concerned, he added.

“But in this case, one is living without visa for one and half year and the other for two months besides they have been booked in a criminal case. The case will be registered after DA’s comments,” said Kant.

In the second complaint, the SHO said they had called the complainant woman but she was finding it difficult to identify them.

The two arrested youths are in jail.

The three, including the one who managed to flee, have been booked under section 380 of the IPC on the complaint of Jaspal Kaur, the grocery store owner.
