Consumer forum directs car dealer to pay back extra charges to customer

The Jalandhar district consumer disputes redressal forum has directed a local car dealer to pay Rs 15,500 to one of the complainant, who was charged extra by dealer against the actual price of the car.

The complainant Arvind Randev, a resident of Tagore Park, stated before forum that he booked Hyundai Verna car with Goyal Automotive, an authorized dealer of Hyundai make cars, and deposited Rs 50,000 on June 8, 2011. Two and a half months later the dealer informed him that his booking had materialized.

After which Arvind deposited the remaining amount of Rs 8.39 lakhs on August 27, 2011, according to the car's price list in July 2011.

The dealer told Arvind that they couldn't make the car delivery immediately, and to contact them after a week. On September 9, 2011, he again approached the dealer to take delivery of his car, but representatives of the agency asked him to deposit remaining Rs 15,500 balance price of car.

He was told by agency officials that price list of car was revised with effect from September 1, 2011 and he had to pay the money as per revised list.
Arvind lodged a complaint agains this in consumer forum and appealed to refund the extra money charged from him.

In its reply in the forum, auto dealer denied the fact of charging any extra money from complainant and pleaded that he has to deposit prevailing revised price.

After considering the statements of both the parties the forum observed that the complainant had deposited entire amount before the price hike. Though the dealer was not justified in receiving extra amount on the ground of revised price list, which was with effect from September 1, 2011.

In its judgment the bench comprising president Jaspal Singh Bhatia and members Darshan Singh and Jyotsna Thatai ordered the dealer to pay Rs 15,500 to complainant along with Rs 1,000 as litigation expenses and compensation.
