The decision came from justice KC Puri when CBI's special prosecutor Sukhdeep Singh Sandhu stongly objected to grant of bail to Sushma submitting that she was actively involved in illegal activities in Apna Ghar sexual abuse case. He had argued that Sushma was not only involved in atrocities on the Apna Ghar inmates but also used to take their nude pictures.

The National Commission for the Protection of Child Rights (NCPCR) had, May 9, 2012, conducted a raid at Apna Ghar and rescued 103 inmates from sexual and physical abuse.

However, justice Puri directed other three accused namely Ram Prakash Saini, Angrez Kaur Hooda and Roshni to surrender before the special CBI court, Panchkula on or before March 24 that would consider granting them anticipatory bails. If the three accused fail to surrender, the high court made it clear that the interim relief granted to them regarding stay of arrest would be withdrawn. All the three accused were named in the supplementary charge sheet filed by CBI in special CBI court at Panchkula on September 16 last year

At the same time, the court approved regular bail of another accused in the case, Veena, while considering that she had a small child and her husband was no more. There were allegation against Veena that she had sold child from Apna Ghar but her counsel informed the court that she used to hand over sale money to the Apna Ghar caretaker.
